  1. Notice for marriage- The parties to the court marriage would have to send a notice to the marriage officer under whose jurisdiction either of the parties live. The parties would have to give the notice of the intended marriage in writing and in the form as has been prescribed under the Second Schedule of the Act of 1954.

  2. Publish the notice- Marriage officers would then publish a notice for marriage by affixing it in some inconspicuous part of the office so that it could be seen by the general public. The notice shall be published for a period of 30 days from the day the notice was submitted, so as an objection against the marriage could be raised within this period.

  3. Objection- Provided under Section 7 of the Act, an objection to court marriage can be raised on the basis of the grounds provided under Section 4 of the Act, thus objection could be raised not on personal basis but on legal grounds mentioned under the Act. The marriage officer under Section 8, would then enquire about the validity of the objection raised within a period of 30 days from the day the objection was raised.. In case the objection so raised is found to be invalid, the marriage officer shall solemnise the marriage.

  4. Parties and the witnesses are required to be present on the date of marriage- Three witnesses must be present in the court marriage. Signature as well as declaration as has been mentioned under Third Schedule of the Act, the parties and the witnesses must sign the documents in the presence of the Marriage officer.

  5. Certificate of Marriage- After the procedure discussed above has been completed, the parties will be provided with a marriage certificate. The certificate for court marriage must be signed by parties and the witnesses. The certificate so issued is conclusive evidence of the court marriage.
